Overview

Elisabeth (Bess) Morgan focuses her practice on helping clients acquire, protect, enforce and exploit their intellectual property and other proprietary rights.

Bess provides strategic counsel across all stages of brand development, protection and enforcement. She has extensive experience advising clients on U.S. and global brand selection, clearance and filing strategy, and manages large domestic and international trademark portfolios. Bess works closely with clients to address unauthorized uses of their proprietary rights in ways that both protect their intellectual property and advance their broader business objectives. Her work spans a wide range of industries, including media, entertainment, esports, pet care, advertising, food and beverage (including alcoholic beverages), retail, technology, hospitality, apparel, and health and wellness.

Bess has a particular focus on representing influential brands and individual talent—including musicians, actors, celebrities, athletes, content creators and influencers—in connection with sponsorships, endorsement agreements, and licensing and co-branding collaborations. Bess also regularly advises clients on compliance with Federal Trade Commission endorsement guidelines and structures deals that align with the evolving legal and commercial landscape. Her work includes counseling on IP and persona rights in the context of content creation, branded entertainment and cross-platform marketing partnerships.

Bess is a member of the International Trademark Association's (INTA's) Right of Publicity Sports, Actors & Celebrities Subcommittee, where she collaborates with a team of lawyers from around the world to discuss how changes in the legal landscape—specifically regarding AI—impact talent.

Bess plays an active role in Loeb & Loeb’s Women’s Affinity Group and maintains a robust pro bono practice.
